TERMS AND CONDITIONS

 

1. Introduction
These Terms and Conditions ("Terms") govern the provision of photography services by Marcus Posthumus / VisualCraic.com ("Photographer", "we", "us", "our"). By booking our services, you ("Client", "you") agree to these Terms.

 

2. Services
We provide staged "paparazzi-style" photography services and editorial magazin-like photo shoots. All sessions are pre-arranged and consensual.
We do not engage in real paparazzi activity, surveillance, or any form of harassment.

 

3. Booking and Payment

  • A booking is confirmed upon receipt of agreed payment or deposit.

  • Full payment must be made prior to or on the day of the shoot unless otherwise agreed.

  • Prices are subject to change but will not affect confirmed bookings.
    Pricelist as shown on website.

 

4. Cancellations and Rescheduling

  • Clients may cancel or reschedule with at least 48 hours' notice by email to office@visualcraic.com.

  • Deposits may be non-refundable unless otherwise agreed.

  • We reserve the right to reschedule due to unforeseen circumstances (e.g. weather, illness).

 

5. Client Responsibilities
The Client agrees that:

  • All individuals being photographed have given their full consent.

  • The location permits photography.

  • No illegal, unsafe, or misleading situations will be staged.

The Client is fully responsible for obtaining any necessary permissions.

 

6. Consent and Model Release
The Client warrants that all persons appearing in the photographs have granted permission to be photographed and for the images to be used as agreed.
We are not responsible for claims arising from lack of consent.

 

7. Copyright and Usage Rights

  • The Photographer retains full copyright of all images.

  • The Client receives a non-exclusive, non-transferable license for personal use including sharing on social media unless otherwise agreed.

  • Commercial use requires prior written consent and may incur additional fees.

 

8. Artistic Style
The Client acknowledges that they are familiar with the Photographer’s style.
No refunds will be issued based on subjective dissatisfaction with artistic interpretation.

 

9. Delivery

  • Images will be delivered digitally within an estimated timeframe, usually 3 to 5 working days, communicated after the shoot. Depending on choosen package, printed images will be delivered by post or personally.

  • The number of images delivered is at the Photographer’s discretion unless otherwise agreed or displayed in package description.

 

10. Use of Images
We reserve the right to use images for portfolio, website, and promotional purposes.
Clients may request in writing that their images not be used.

 

11. Privacy and Data Protection
We process personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).
Personal data and images will not be shared with third parties without consent unless required by law.

 

12. Limitation of Liability
We are not liable for:

  • Indirect or consequential damages

  • Loss caused by events beyond our control

  • Technical failures or unforeseen issues

Our total liability shall not exceed the amount paid for the services.

 

13. Conduct and Safety
We reserve the right to refuse or terminate a shoot if:

  • Safety is compromised

  • Individuals are harassed or placed in uncomfortable situations

  • The agreed staged nature of the shoot is violated

 

14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ireland.
Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.

 

15. Amendments
We reserve the right to update these Terms at any time. The latest version will be published on our website.

16. Custom Magazine-Style Designs

As part of the services, the Photographer may create custom-designed magazine-style covers and editorial layouts using the Client’s images.

These designs are:

  • Entirely fictional and created for artistic and entertainment purposes only

  • Not affiliated with, endorsed by, or connected to any real magazine, publisher, or brand

  • Not intended to replicate or imitate any specific existing publication

The Client acknowledges that:

  • All text, headlines, and layouts are created by the Photographer for creative effect

  • The content may be exaggerated, stylized, or fictionalized

  • The designs must not be represented as real publications or used in a misleading or deceptive manner

The Photographer reserves the right to refuse requests that involve imitation of real brands, defamatory content, or potentially unlawful use.

Usage of these designs is limited to personal use unless otherwise agreed in writing.
